COLOMBIA ECOTRAVEL – Booking Terms and Conditions

These Booking Terms and Conditions ("Agreement") constitute a legally binding contract between you ("Client," "you," or "your") and COLOMBIA ECOTRAVEL LLC ("COLOMBIA ECOTRAVEL," "CET," "we," "us," or "our"), a Wyoming limited liability company operating at https://colombiaeco.travel.
By booking a trip, submitting a booking form, paying a deposit, clicking "I agree," or otherwise confirming travel arrangements with us, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you are booking on behalf of other travelers, you confirm that you have authority to bind them to this Agreement and that they have been made aware of and accept these terms.
COLOMBIA ECOTRAVEL creates unique and curated eco-tours throughout Colombia for solo travelers, couples, and small groups. We also operate as a Destination Management Company (DMC) for other tour operators. Our services may include, but are not limited to, arranging accommodations, transportation, guided excursions, meals, and other travel-related activities as described in your itinerary.
2A. Regenerative Travel & Environmental Impact
As part of our mission to support regenerative travel and positive local impact, COLOMBIA ECOTRAVEL partners with "Saving the Amazon" and pledges to plant a minimum of five (5) native trees for each trip booked. This reforestation pledge is a non-monetary contribution included as part of your trip experience and is not a cash value benefit, credit, discount, or refund component of your booking. The timing, location, species selection, and verification of tree planting are administered by our partner and are subject to the partner's processes, availability, and terms. COLOMBIA ECOTRAVEL does not guarantee specific planting dates, geolocations, or individual tree survival.
3.1 Deposit
A non-refundable deposit is required to confirm your booking. The deposit amount will be specified at the time of booking and is due upon submission of your booking request. All deposits are non-refundable once paid, regardless of the reason for cancellation.
3.2 Final Payment
The remaining balance of your trip cost is due no later than sixty (60) days before your scheduled departure date. For bookings made within sixty (60) days of departure, the full trip cost is due at the time of booking.
3.3 Payment Methods
We accept payment by major credit cards processed through Stripe. By providing
your payment information, you authorize COLOMBIA ECOTRAVEL to charge the applicable amounts to your designated payment method.
3.4 Currency
All prices are quoted in US Dollars (USD) unless otherwise specified.
3.5 Chargebacks and Payment Disputes
If you have a billing question or dispute, please contact us first at [Insert email address] or [Insert phone number] so we can look into it and try to resolve it quickly. You agree not to initiate a chargeback for amounts you owe under this Agreement, including non-refundable deposits and amounts subject to our cancellation or change policies. If a chargeback is filed contrary to this Agreement, we may dispute it, provide supporting documentation to the processor, and seek recovery of any amounts improperly charged back, plus any related fees we incur.
All cancellations must be submitted in writing via email to our team. The date of cancellation is the date we receive your written notice. All timeframes are calculated based on calendar days before your scheduled departure date in Colombia, using Eastern Time (ET) as the reference time zone.
4.1 Cancellation by Client
The following cancellation fees apply:
4.2 No-Shows
Failure to appear for your scheduled departure without prior written cancellation constitutes a no-show and results in forfeiture of 100% of your trip cost. No refunds or credits will be issued for no-shows.
4.3 Cancellation by COLOMBIA ECOTRAVEL
We reserve the right to cancel any trip due to insufficient enrollment, safety concerns, force majeure events (see Section 9), or other circumstances beyond our reasonable control. In such cases, we will offer you the choice of:
A full refund of all amounts paid to COLOMBIA ECOTRAVEL (including your deposit), or
A credit toward a future trip of equal or greater value.
Our liability in the event of cancellation by COLOMBIA ECOTRAVEL is limited to amounts actually paid to us and does not include reimbursement for airfare, travel insurance, visa fees, or other expenses incurred by you.
Refunds, where applicable under this Agreement, will be issued to the original payment method within 7–10 business days after we confirm your cancellation in writing (Stripe refunds processing fees). COLOMBIA ECOTRAVEL is not responsible for delays caused by your financial institution or payment provider.
6.1 Changes by Client
If you wish to modify your booking (dates, accommodations, activities, etc.), please contact us as soon as possible. We will make reasonable efforts to accommodate
your request, but changes are subject to availability and may incur additional fees. Modifications made within sixty (60) days of departure may be treated as a cancellation and rebooking, subject to the cancellation fees in Section 4.
6.2 Changes by COLOMBIA ECOTRAVEL
We reserve the right to make changes to your itinerary before or during your trip due to circumstances beyond our control, including but not limited to: weather conditions, road closures, supplier availability, safety concerns, or government regulations. We will notify you of material changes as soon as reasonably practicable and will endeavor to provide alternatives of comparable value. Itinerary changes do not entitle you to a refund unless we cancel the trip entirely.
6.3 Price Adjustments
Prices are subject to change until we issue a written booking confirmation. After confirmation, we may adjust prices only to reflect:
Changes in government-imposed taxes, fees, or levies, or
Currency fluctuations exceeding 5% from the date of booking.
We will notify you in writing of any price increase. We will not apply any material increase without your written consent. If the increase exceeds 10% of your total trip cost, you may cancel within seven (7) days of receiving notice and receive a refund of all amounts paid except your non-refundable deposit.
COLOMBIA ECOTRAVEL acts as an intermediary between you and various third-party suppliers, including but not limited to hotels, lodges, airlines, ground transportation providers, boat operators, and local guides ("Suppliers"). These Suppliers are independent contractors and are not employees, agents, or representatives of COLOMBIA ECOTRAVEL.
7A. Seller of Travel and Residency Restrictions
7A.1 Seller of Travel (California and Washington)
COLOMBIA ECOTRAVEL LLC is not a registered Seller of Travel in the State of California or Washington.
7A.2 Florida Seller of Travel
COLOMBIA ECOTRAVEL LLC is not currently registered as a Seller of Travel in the State of Florida.
7A.3 Hawaii Residency Restriction
COLOMBIA ECOTRAVEL LLC does not offer, sell, or provide travel services to residents of the State of Hawaii. By booking, you represent and warrant that you are not a resident of Hawaii.
7.1 Supplier Terms
Your use of Supplier services may be subject to the Supplier's own terms and conditions, which are incorporated by reference. You agree to abide by all Supplier terms.
7.2 Supplier Performance
COLOMBIA ECOTRAVEL is not liable for any act, omission, negligence, default,
delay, cancellation, overbooking, or failure to perform by any Supplier. This includes, without limitation, injury, death, property damage, inconvenience, or loss of enjoyment arising from Supplier services.
7.3 Supplier Refunds
In the event of a Supplier cancellation, delay, or failure to perform, we will use reasonable efforts to obtain refunds or credits from the Supplier on your behalf. Any refund or credit provided to you is limited to amounts we actually recover from the Supplier, minus any non-refundable charges imposed by the Supplier. We do not guarantee any refund from Suppliers.
8.1 Travel Documents
You are solely responsible for obtaining and maintaining valid travel documents, including passports, visas, and any required permits. COLOMBIA ECOTRAVEL is not liable for any costs, delays, or inability to travel resulting from inadequate or missing documentation.
8.2 Travel Insurance
We strongly recommend that all travelers purchase comprehensive travel insurance covering trip cancellation/interruption, medical expenses, emergency evacuation, baggage loss, and personal liability. Travel insurance is your responsibility, and COLOMBIA ECOTRAVEL is not liable for any losses that would have been covered by adequate insurance.
8.3 Health and Fitness
Many of our tours involve physical activities such as hiking, walking on uneven terrain, boat travel, and exposure to altitude and tropical conditions. By booking, you confirm that:
You are in adequate physical and mental health to participate in your selected trip.
You have disclosed any medical conditions, allergies, dietary restrictions, or mobility limitations that may affect your participation.
You have consulted with a medical professional regarding vaccinations, medications, and fitness for travel to Colombia.
We reserve the right to refuse participation or remove any traveler whose condition, in our sole judgment, poses a risk to themselves or others, without refund.
8.4 Safety & Liability Waiver Requirement
All participants are required to sign a separate Safety & Liability Waiver prior to departure. Participation in the tour is contingent upon the receipt of this signed document. Failure to sign the waiver may result in cancellation of the booking without refund.
8.5 Wildlife Interaction & Conservation
Colombia Ecotravel trips may include opportunities to observe wildlife in natural habitats (including, without limitation, humpback whales, jaguars, spectacled bears, birds, reptiles, amphibians such as the Golden Poison Frog, and other species). To protect wildlife, habitats, and local communities, you agree to follow a strict code of conduct, including:
Follow all instructions from guides, local authorities, park rangers, and Suppliers at all times.
Maintain a safe and respectful distance from wildlife; do not approach, touch, chase, crowd, corner, or attempt to feed any animal.
Do not disturb habitats (including nesting, breeding, or feeding areas) and do not remove plants, animals, feathers, shells, rocks, or any natural or cultural artifacts.
Keep noise to a minimum when near wildlife and comply with any rules regarding lights/flash photography, drones, or other equipment.
Do not purchase, collect, transport, or trade wildlife or wildlife products, and comply with all applicable conservation and protected-area regulations.
We may refuse participation, modify activities, or remove any traveler from an activity or the trip (including for safety or conservation reasons) if, in our sole judgment, the traveler’s behavior endangers wildlife, the environment, other travelers, or local communities. No refunds will be issued in such circumstances.
COLOMBIA ECOTRAVEL is not liable for any failure or delay in performing our obligations due to causes beyond our reasonable control, including but not limited to: natural disasters, epidemics or pandemics, war, terrorism, civil unrest, government actions, strikes, transportation disruptions, or other force majeure events.
In the event of force majeure affecting your trip, we will work with you to reschedule or provide a credit for future travel. Refunds in force majeure situations are subject to amounts we are able to recover from Suppliers and are not guaranteed.
10.1 Assumption of Risk
Travel involves inherent risks, including but not limited to: accidents, illness, injury, property damage, political instability, crime, terrorism, natural disasters, wildlife encounters, and transportation incidents. Our trips may also include remote nature expeditions and activities in areas with limited access to medical care, delayed emergency response, challenging road and weather conditions, and infrastructure limitations. Activities may include (without limitation) high-altitude hiking and exposure to altitude-related illness, boat travel, travel in rural or wilderness environments, and potential encounters with wildlife in their natural habitats.
By booking with COLOMBIA ECOTRAVEL, you voluntarily assume all risks associated with your trip, whether known or unknown, foreseeable or unforeseeable.
10.2 Release and Waiver
To the fullest extent permitted by law, you release, waive, and discharge COLOMBIA ECOTRAVEL, its owners, officers, employees, agents, and affiliates from any and all claims, demands, damages, costs, expenses, and liability arising out of or related to your trip, including but not limited to claims for personal injury, death, property damage, delay, inconvenience, or emotional distress.
10.3 Indemnification
You agree to indemnify, defend, and hold harmless COLOMBIA ECOTRAVEL from any claims, damages, losses, or expenses (including reasonable attorneys' fees)
arising from your breach of this Agreement, your violation of any law, or your negligent or wrongful conduct.
To the maximum extent permitted by law, COLOMBIA ECOTRAVEL's total liability to you for any and all claims arising out of or related to your trip or this Agreement shall not exceed the total amount you paid to COLOMBIA ECOTRAVEL for your trip.
In no event shall COLOMBIA ECOTRAVEL be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of enjoyment, lost profits, or emotional distress, even if we have been advised of the possibility of such damages.
By participating in a COLOMBIA ECOTRAVEL trip, you grant us permission to use photographs, video, or other media taken during your trip for promotional, marketing, and educational purposes, including on our website, social media, and printed materials, without compensation. If you do not wish to be photographed, please notify us in writing before your trip.
By booking with us, you consent to receive booking-related communications via email, phone, SMS, or messaging applications (such as WhatsApp) at the contact information you provide. You may opt out of non-essential marketing communications at any time. You can manage your preferences or opt out using the links in our messages or by contacting us at [Insert email address]. Your personal information is handled in accordance with our Privacy Policy, available at https://colombiaeco.travel/pri.... By booking, you acknowledge that you have reviewed and accept our Privacy Policy.
15.1 Informal Resolution
Before starting any formal dispute process, please contact COLOMBIA ECOTRAVEL at [Insert email address] or [Insert phone number] and give us a chance to resolve your concern informally. Most issues are resolved quickly, and we aim to respond within [X] business days.
15.2 Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to this Agreement or your trip that cannot be resolved informally shall be resolved exclusively through binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules then in effect.
Location: Arbitration shall take place in Cheyenne, Wyoming, USA, or remotely via video conference at the arbitrator's discretion.
Language: All arbitration proceedings shall be conducted in English.
Governing Law: The arbitrator shall apply the substantive laws of the State of
Wyoming, USA, without regard to conflict of law principles.
15.3 Class Action Waiver
You agree that any arbitration or legal proceeding shall be conducted on an individual basis only. You waive any right to participate in a class action, collective action, or representative proceeding, whether as a plaintiff, class member, or otherwise.
15.4 Costs
Each party shall bear its own costs and attorneys' fees, unless the arbitrator determines that a claim was frivolous, in which case the arbitrator may award reasonable fees to the prevailing party.
15.5 Injunctive Relief
Notwithstanding the above, either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent irreparable harm.
This Agreement shall be governed by and construed in accordance with the laws of the State of Wyoming, USA, without regard to its conflict of law provisions.
If any provision of this Agreement is found to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, such finding shall not affect the validity of the remaining provisions, which shall continue in full force and effect.
This Agreement, together with your booking confirmation and itinerary, constitutes the entire agreement between you and COLOMBIA ECOTRAVEL regarding your trip and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.
Our failure to enforce any provision of this Agreement shall not constitute a waiver of that provision or any other provision. Any waiver must be in writing and signed by COLOMBIA ECOTRAVEL to be effective.
